This presentation will commence with a high level review of intellectual property law and remedies available.  A discussion will follow regarding quantifying intellectual property losses with examples from actual cases.  Topics in this regard will include:

• Accounting of Profits / Disgorgement of Profits
• Lost Profits and / or Reasonable Royalty
• The “Loss Period”
• Convoyed Sales
• Irreparable Harm – Assistance a CBV can provide in matters where an interlocutory injunction is sought
• Complications In Assessing Losses.

The final part of the presentation will include a discussion of current issues and recent cases regarding intellectual property damages.
